Multi-State Listeriosis Outbreak Results in Death for Two Coloradans

September 20, 2011 by The Sawaya Law Firm

Most of us go about our daily lives completely unaware of some of the dangers we face in the simple act of living. But in a recent incident involving the ingestion of cantaloupe, two Coloradans and their families experienced the ultimate sacrifice: loss of life.

After eating Rocky Ford cantaloupe purchased at their local grocery stores, people in several states, including Nebraska, Texas and Colorado, became suddenly ill, reporting symptoms such as gastrointestinal distress, fever, chills, muscle pain, vomiting and severe headache.

The Centers for Disease Control (CDC) later determined that cantaloupe infected with listeriosis was the source of the illness, which is often transmitted through vegetables, meats and raw milk products that have come into contact with contaminated soil or manure left by infected animals. In its severest form, this dangerous infection can result in meningitis, pneumonia, septicemia (a blood infection), endocarditis (infection of the lining of the heart) and, ultimately, organ failure.

This outbreak is currently under investigation by three state health departments, the Food and Drug Administration (FDA) and the US Department of Agriculture’s (USDA) Food Safety Inspection Service. But for the families of the two unfortunate Coloradans who died as a result, nothing can bring their loved ones back.

Who is responsible for these deaths? The cantaloupe growers? The distributors? Or possibly the grocery chains who bought and resold the fruit?

Those who suffered serious illness from the outbreak are advised to seek legal counsel for possible redress and recovery of damages. Those survivors of victims who have died would be wise to seek counsel for what is generally called “wrongful death.” A qualified lawyer or law firm, such as The Sawaya Law Firm, can answer those questions. Investigation and gathering of evidence is essential to these cases and time is always of the essence.
