Vaping pen, vape devices, mods for electronic cigarette or e cigarette, e cig, on a wooden background

The use of JUUL and other vaping devices has reached epidemic levels –especially among teenagers and young adults. JUUL and other vape device manufacturers appear to have fueled this epidemic by targeting and deceiving young people with misleading social media marketing and sweet, fruit-flavored pods containing high levels of nicotine that lead to vaping addiction. Several experts have linked the use of these products to numerous adverse health effects such as:

  • Nicotine addiction
  • Nicotine poisoning
  • Seizures
  • Breathing problems
  • Lung infections
  • Behavioral and psychological problems
  • Many other serious health conditions.

If you or a loved one have used JUUL or other vaping devices and experienced any adverse physical or psychological symptoms that may be associated with use of the product(s), get in touch with The Sawaya Law Firm without delay. What Is JUUL?

JUUL is similar to many other types of vaping devices, or electronic nicotine delivery systems (ENDS). People may call these devices e-cigarettes, e-cigs, vapes, vape pens, e-hookahs, mods or tank systems. The devices deliver nicotine – or other drugs such as THC or CBD – through an aerosol rather than smoke. When a person puffs on a JUUL or another type of e-cigarette, the suction activates a battery-powered heating element that converts a liquid solution (or “e-juice”) to an aerosol which a person inhales and exhales.

E-cigarettes have been around for more than a decade. However, vaping exploded in recent years after San Francisco-based JUUL Labs, Inc. put its JUUL vaping devices and JUUL pods on the market in 2015.

Vaping has especially spiked among youth in Colorado and throughout the country. As the U.S. Food and Drug Administration (FDA) reports, between 2017 and 2018, e-cigarette use:

  • Rose by 78 percent among high school students
  • Increased by 48 percent among middle school students.

A major reason for this sharp increase: JUUL and many other vaping products delivers a high dose of nicotine in every puff. At the same time, they may cause little to no throat irritation. As a result, people can easily become addicted to them.

Additionally, companies have aggressively marketed these products to young people through print, broadcast and digital mediums. They typically portray their products as being a safe alternative to cigarettes and make it seem cool and hip to vape. They have also provided consumers with a variety of flavors such as mango, cool mint, grape and bubblegum. Even the design of a JUUL device – it looks like a USB flash drive – seemingly is aimed at appealing to young people.

It may come as no surprise that “Big Tobacco” is behind many of these products. For instance, Richmond-based Altria recently acquired a major stake in JUUL Labs, Inc. Phillip Morris USA, Inc. – the largest cigarette company in the country and the maker of the country’s most popular cigarette brand, Marlboro – is a wholly owned subsidiary of Altria.

What Illnesses Are Linked to JUUL and Other Vaping Products?

The U.S. Surgeon General starkly warns, “E-cigarette aerosol is not harmless.” According to the U.S. Centers for Disease Control and Prevention, when you vape, you inhale an aerosol that may contain not only nicotine but also:

  • Particles that can enter deeply into your lungs
  • Diacetyl, a chemical linked to “popcorn lung” – a serious lung disease
  • Heavy metals such as nickel, tin and lead
  • Volatile organic compounds
  • Cancer-causing chemicals.

Several organizations have come out with additional warnings about the dangers of e-cigarette use, including:

  • American Lung Association – According to the ALA, vaping can lead to lung injury, asthma, lung cancer and chronic obstructive pulmonary disease (COPD).
  • American Stroke Association – The organization warns that vaping or “JUULing” raises one’s risk of a seizure, stroke, heart attack or coronary artery disease.
  • American Academy of Pediatrics – This organization has called for immediate federal intervention to restrict the marketing and sale of e-cigarettes to youth. The AAP is especially concerned about the impact of nicotine addiction on adolescent brain development.

To get an idea of how dangerous vaping can be, all you have to do is look at recent headlines. As Colorado Public Radio reports, more than 500 cases of vaping-related lung illnesses have been reported in 38 states, including 11 reported deaths and six hospitalizations. Eight of those cases have been reported in Colorado.

Are People Filing Lawsuits Against JUUL?

The federal government is finally taking action. Lawmakers have recently taken steps to ban flavored vaping products. Also, in September 2019, the FDA wrote a warning letter to JUUL Labs, Inc., telling the company to immediately cease the marketing of its products to our country’s youth. In the wake of that letter and the string of vaping-related lung illnesses which have swept the country, JUUL’s CEO stepped down, and the company announced that it would suspend all of its advertising. But those steps are simply too late for too many consumers in Denver and across the country.

Today, consumers who have suffered illness after using JUUL and other e-cigarette brands are taking action. They have filed lawsuits in state and federal courts across the country. These lawsuits demand that companies be held accountable for manufacturing, marketing and selling products that are highly addictive and potentially dangerous while, at the same time, failing to adequately warn consumers about the serious health risks which their products pose.
