Denver University, DBA “Fisher Early Learning Center”

This lawsuit alleges that in 2016, DU recognized that it has misclassified its preschool caregivers as “exempt” from the overtime requirements of the Fair Labor Standards Act and Colorado wage and hour law. As a result, DU owed the caregivers overtime for the hours they worked in excess of 40 per week or 12 per day. Our clients allege that instead of paying their employees for all of the overtime that they worked, DU arbitrarily paid them for less than all of the overtime hours they claimed to have worked. In November 2017, the Court conditionally certified the case as a collective class action under the Fair Labor Standards Act. Its order certifying the case can be viewed here.
