An employee working in CSU’s Office of Student Affairs has filed lawsuit claiming that CSU failed to properly pay overtime compensation to him and a class of “non-student, non-exempt hourly workers” at CSU. The employee alleges that CSU violated the Fair Labor Standards Act by (1) improperly “averaging” overtime hours over a two-week period; and (2) compensating for overtime work at employees’ regular rates of pay, instead of one and one-half times their regular rates of pay. The case is currently in front of the U.S. District Court for the District of Colorado as Banton v. Board of Governors, Civil Action No. 1:18-cv-00793. We are currently in the “discovery” process of the case, in which we are obtaining information and documents from CSU.
