Many times, once someone has applied for Social Security Disability or filed a request for hearing, the Social Security Administration will send them for a consultative examination which is paid for by the Social Security Administration. The consultative examiner is supposed to receive the Disability report which the Social Security claimant has completed, a copy of the relevant medical evidence and any questionnaires the claimant has completed (POMS DI 22510.016 C.1.a.). However, in reality, may times the consultative examiner has not received anything before the exam and then prepares a report. It is the claimant and/or attorneys role to investigate and research what evidence the consultative examiner viewed before completion of the report if it will be relied upon by the Administrative Law Judge.
