How Lawsuits Make Your Life Safer

January 3, 2013 by The Sawaya Law Firm

There is no way to replace the lives that were lost in the shooting during Century 16 Theater’s premiere of The Dark Knight Rises. The events that took place that night were a terrible act that will forever change the lives of anyone involved.

When terrible situations like this arise, we must begin to look at how it could have possibly been prevented. In a crowded movie theater in which all patrons are focused in one direction, sitting idly, security measures must be in place.

Lawsuits can often be misconstrued as being a reason for a person/people to make money at the expense of others. Yet, the true reason for many lawsuits, such as the one against the Cinemark (the owner of Century 16), are brought up are to ensure that products or situations are safer in the future.

It is clear that certain products and places we use daily have been made safer by lawsuits. Watching your kids play on a playground while sitting on a park bench is generally thought of as a safe practice. One of the reasons this is so is due to the litigation involving the way playgrounds are constructed to minimize injuries of playing children. Automobiles, cribs, car seats, hospitals, grocery stores, swimming pools, parking lots, and so many more places/products have been made safer due to lawsuits impacting the safety procedures that go into development. The list goes on and on.

The lawsuit against Cinemark is being pursued by our firm in order to let the movie industry know that minimal security measures will be required in the future, because unfortunately, that message does not seem to have been received by that industry to this date. We would hope to be able to assure at least a minimal amount of security for movie-goers in the future. At this time, we are not in a position to discuss all the aspects of safety that we believe were deficient and need to be fixed by theatres in the future, because it is a subject of Federal Court action at the present.

From any proceeds that this firm receives as a fee in the theatre shooting cases, we intend to make a donation to a group or groups dealing with the mental illness issues that seem to be at the root of these terrible acts of mass shootings.

If we can help in any way, whether it be by implementing better security measures in theaters and public places, or by assisting in mental health research, then ultimately we will have succeeded and the purpose for this lawsuit will have been achieved.
