Auto Accident Honesty
“Okay, now I’d like to talk about your prior accidents,” says Colorado defense counsel during my client’s deposition. “Do you recall being involved in a car accident three years ago?”
“Oh yes,” says my auto accident client.
I flash back to our meeting 5 months earlier when I specifically asked client if there were any previous auto accidents, to which I received a very emphatic “NO, never! I’ve never had any car accidents at all before this one!”
“Were you hurt in that car collision?”
“Not really, I just had some physical therapy and chiropractic treatment for my back.”
“And you are claiming that your back was injured in the latest car crash as well, correct?”

As I resist the urge to bang my head on the conference table, I recall the sage words of Daniel Kaffee in “A Few Good Men”: Something doesn’t go our way, don’t hang your head, don’t shift in your seat, don’t scribble furiously. Whatever happens, you have to look like it’s exactly what you knew was gonna happen.
No auto accident attorney wants to hear their client’s prior car accident history for the first time in sworn testimony to the opposing attorney. Candidness with your attorney about prior auto accidents, injuries, and workers’ compensation claims is vital in the prosecution of your personal injury claim. It is essential that we know the entire scope of not only your car accident history, but also your prior medical treatments – specifically those related to the same or similar injuries which you now claim as a result of a car collision.
In today’s information age, it can never be assumed that information is secret. Insurance companies have large data bases full of information and any attempt to withhold, hide, or otherwise try to obscure auto accident or injury history will only serve to damage a client’s credibility once the truth is discovered. As your personal injury attorneys, we need this information to strategize your case in a way that will best serve you and bring about a fair resolution to your personal injury case.
In the even more sage words of Sir Francis Bacon, “Knowledge is power.”
